Yep - you would be fleeing a RAND company and running to a proprietary system. Please rest assured that those who are able to speak for IBM in these matters are well aware of these discussions and working on a response. Regarding "validity of the IBM claim", I am not sure what sort of validity of what sort of claim is being discussed. Validity of the patent is normally analyzed by the attorneys in any company that might be liable for licensing fees. The chronology is valid in that the patent application was filed a long time ago, well before any standards activity began. The date should be in the patent. The main issue is the very late disclosure. I think I have already commented on that on this list - it was a screw-up, not a malicious act.
